Eighth Appellate District Upholds Ohio Supreme Court Decision

Poling Law wins in Supreme Court of Ohio on bifurcation of punitive damages issue

In Flynn v. Fairview Retirement Community, et al. Poling Law moved the trial court to separate the stages of trial, pursuant to R.C. 2315.21(B), separating Plaintiffs’ compensatory and punitive damages claims in a nursing home case. The trial court denied the motion. Poling Law then appealed the decision to the 8^th District Court of Appeals which dismissed the appeal for not being a final appealable order. Poling Law then successfully sought Ohio Supreme Court review of the case urging that R.C. 2315.21(B), part of Ohio’s tort reform legislation, mandated bifurcation of punitive damages upon motion of any party. Further, because the statute mandated bifurcation and did not permit judicial discretion, the trial court’s denial of the motion was an implicit holding by the trial court that this tort reform measure was unconstitutional. After accepting review of the case, the Ohio Supreme Court held oral arguments in which Poling Law argued that the bifurcation requirements of R.C. 2315.21(B) was constitutional and, as such, not only did the trial court err in denying the motion but, further, the Court of Appeals erred when it dismissed the appeal. Poling Law was successful on both arguments and the Supreme Court issued its decision reversing the Court of Appeals’ dismissal and further instructed the Court of Appeals to order the trial court to apply the bifurcation statute.

The Ohio State Bar Association graduated the third class of its Leadership Academy, which is designed to identify future leaders in the legal community and provide them with support and training, on July 13 at OSBA headquarters in Columbus.

The OSBA initiated the Leadership Academy to help prepare young lawyers to become leaders in their firms, in their communities and in the legal profession. This program familiarizes participants with the vast resources of the OSBA, introduces them to the broader legal community, and provides them with enhanced leadership skills.

Members of the graduating class include lawyers from large and small firms, in large cities and small towns, from a variety of legal disciplines.

Mindi L. Schaefer, lead paralegal and marketing specialist of Poling Law, was awarded Paralegal of the Year 2011-2012 by the Paralegal Association of Central Ohio. With more than 13 years of paralegal experience, Mindi prides herself on “paying it forward” through her mentoring of paralegal students, creation of PACO’s mentoring program, active involvement with PACO’s executive board, and work for various PACO committees. Mindi is currently PACO’s president-elect, public relations representative, and mentoring program chair.

Erin Cafferkey, paralegal at Poling Law, was awarded Outstanding New Member 2011-2012 by the Paralegal Association of Central Ohio. Cafferkey was instrumental in PACO’s recent mentoring program ice cream social as well as her constant work with PACO’s public relations committee.
